<h3>We See What You Do, We Hear What You Say</h3>
<p>Through the years public concern about workplace privacy has grown. Laws in   almost every state allow the monitoring of employees in the course of their work   day. Advanced technology has made it possible to monitor workers while on and   off the employer&#8217;s premises. As technology advances, methods to monitor   employees become more sophisticated. Current laws don&#8217;t address every issue that   is raised regarding workplace privacy. </p>
<p>From a company perspective, workplace monitoring is essential to the daily   operation of the business. The work ethic in America has changed over the years   from the &#8220;traditional&#8221; standard of job commitment, achievement, and high ethical   values to a new lower work ethic of wanting more and giving less. Companies pay   high costs associated with losses caused by employee theft, vandalism, and   lawsuits. One way to reduce losses and costs is to implement employee   monitoring. A good loss prevention program that incorporates employee monitoring   is a benefit to both employer and employees. </p>

<h3>Employee monitoring</h3>
<p>Employee monitoring has a place in society, and employers do have the right   to monitor employee performance and use of company resources. Employers lose   money when an employee doesn&#8217;t perform the work that she is being paid to do. In   effect, that employee is stealing from her employer by not providing what she   agreed to provide, which is work in exchange for a paycheck. </p>
<p>Contrary to popular belief, monitoring in the workplace also benefits the   employee. For example, a very expensive pair of sun glasses is stolen from Joe   while he is at work. He accuses Dave, his work partner, of taking the glasses   because Dave complemented Joe on them, and said that he wants a pair. Joe goes   to Human Resources and lodges a complaint against Dave. It is discovered that   Dave didn&#8217;t steal Joe&#8217;s glasses; a video camera that is installed in the work   area taped Brian, the custodian, pocketing Joe&#8217;s glasses when he thought no one   was watching. This monitoring process saved Dave&#8217;s reputation and proved who the   real culprit is. </p>
<p>Monitoring employees while on the job is a way that companies have to ensure   that their losses are minimized. There are many different forms of employee   monitoring. There are legal and illegal boundaries, and laws that employers must   adhere to. The employer has the right to videotape places where the employee has   no reasonable expectation of privacy such as work stations, hallways, work   areas, building exterior areas, parking lots, employee break rooms, and common   areas. Other things and activities that employers have the right to monitor   include: </p>
<ul>
<li>Telephone calls that are not personal calls that are made or received using   company telephones </li>
</ul>
<ul>
<li>Voice mail on company voice mail systems </li>
</ul>
<ul>
<li>Email messages, incoming and outgoing that are to or from a work email   address </li>
</ul>
<ul>
<li>Internet usage from company computers </li>
</ul>
<ul>
<li>Use of company computers including keystroke, computer screen, and   hard-drive monitoring </li>
</ul>
<ul>
<li>Instant messaging conducted on company computers </li>
</ul>
<ul>
<li>The use of GPS devices in company cars and company provided cell phones to   track location, driving speed, and other work related activities. </li>
</ul>
<p>Safety and litigation issues also warrant workplace monitoring. A video tape   is an excellent witness when details of an on-the-job accident are not clear, or   a workplace issue is being litigated and facts are missing. </p>
<p>Laws vary from state to state on how far an employer can go to monitor   employees. Employees have a reasonable expectation of privacy in restrooms and   locker rooms. In most states it is illegal to monitor employees while they are   in the restroom or locker room because activities that are carried out in these   places are things that are not normally done in public. They are private acts,   and the employee has a reasonable expectation of privacy during these   activities. </p>
<p>There are also legal issues surrounding the monitoring of underage employees   in places where there is a reasonable expectation of privacy. In many states,   lawsuits and criminal charges can be brought against employers that conduct   monitoring of minors during private moments. </p>
<p>Employers that practice workplace monitoring should have clear policies on   what activities they monitor. They should have a company resource use policy   which is clear, and states exactly what the employer&#8217;s expectations of employees   are in relation to the written policies. </p>
<p>From the standpoint of the employee, trust and value as an employee is   important when it comes to performing the job effectively. Most employees don&#8217;t   want their every move scrutinized, and constant monitoring is cause of   controversy regarding this widespread practice. In organizations where employee   monitoring is intense, employee morale is diminished, and productivity is lower   than in organizations where employee monitoring is reasonable. </p>

<h3>Employee Rules</h3>
<p><strong>Telephone use</strong> - use company telephones for   corporate business only. Receive and place personal calls from a personal cell   phone or from a phone that is designated by the employer for personal use. </p>
<p><strong>Voice mail</strong> - use company voice mail for   business only. Encourage family and friends to leave personal voice mail on your   home voice mail or personal cell phone. </p>
<p><strong>Email</strong> - use the company email system for   company business only. Don&#8217;t check a web-based email account such as Yahoo or   Hotmail from a company computer because the contents of the email will also be   monitored. Limit sending and receiving personal email to non-company computers. </p>
<p><strong>Internet</strong> &#8212; use the Internet from company   computers for work purposes only. Resist the temptation to surf and visit   websites that are not related to the job being performed. </p>
<p><strong>Company computers and hard-drives</strong> - use for   work and storage of company documents. Do not use the company computer for   personal use, and do not store personal documents on the hard-drive of the   computer. </p>
<p><strong>Instant messaging</strong> &#8212; some companies use instant   messaging to cut down on communication time. Instant messaging on a company   computer should be used as a business communication tool. Don&#8217;t conduct personal   conversations in IM except from a non-company computer. </p>
<p><strong>Company vehicle or cell phone</strong> &#8212; if a company   car or cell phone is provided to use for the job, use it for work related   functions only. Doing personal errands in a company car, or having personal   conversations on a company cell phone is overstepping boundaries and is not   acceptable behavior. </p>
<p>The majority of employers do monitor their employees. If employee monitoring   is not tolerable, it is best not to apply for a job at that company. Most   companies will state prior to hire if they have employee monitoring in place. If   there are questions, ask them. It is better to be informed before hire than to   be hired and walk away from a job because the electronic eyes and ears are   watching and listening. </p>

<p>Remote monitoring software gives us the ability to monitor from a distance in real time from any computer with an Internet connection. <br />
  Remote monitoring means that you do not need to have physical access to the computers that you want to monitor, and means that you can monitor the computers no matter where you are, how far you are from the computer. You can moitor remotely in another room, at work or away on a business trip, just from a computer with an internet connection. </p>
<p>The presence of remote monitoring software means that you will always know how your your employee/child/spouse is using their computer. Even if you are on the other side of the world, you can check on a computer to make sure that he or she is not abusing his or her computer time. </p>

			<content:encoded><![CDATA[<p>NEW YORK, February 28, 2008—From e-mail monitoring and Website blocking to phone tapping and GPS tracking, employers increasingly combine technology with policy to manage productivity and minimize litigation, security, and other risks. To motivate compliance with rules and policies, more than one fourth of employers have fired workers for misusing e-mail and nearly one third have fired employees for misusing the Internet, according to the 2007 Electronic Monitoring &#038; Surveillance Survey from American Management Association (AMA) and The ePolicy Institute.</p>
<p>E-Mail and Internet-Related Terminations:</p>
<p>The 28% of employers who have fired workers for e-mail misuse did so for the following reasons: violation of any company policy (64%); inappropriate or offensive language (62%); excessive personal use (26%); breach of confidentiality rules (22%); other (12%).</p>
<p>The 30% of bosses who have fired workers for Internet misuse cite the following reasons: viewing, downloading, or uploading inappropriate/offensive content (84%); violation of any company policy (48%); excessive personal use (34%); other (9%).</p>
<p>Internet, E-Mail, Blogs and Social Networking:</p>
<p>Employers are primarily concerned about inappropriate Web surfing, with 66% monitoring Internet connections. Fully 65% of companies use software to block connections to inappropriate Websites—a 27% increase since 2001 when AMA/ePolicy Institute first surveyed electronic monitoring and surveillance policies and procedures. Employers who block access to the Web are concerned about employees visiting adult sites with sexual, romantic, or pornographic content (96%); game sites (61%); social networking sites (50%); entertainment sites (40%); shopping/auction sites (27%); and sports sites (21%). In addition, companies use URL blocks to stop employees from visiting external blogs (18%).</p>
<p>Computer monitoring takes many forms, with 45% of employers tracking content, keystrokes, and time spent at the keyboard. Another 43% store and review computer files. In addition, 12% monitor the blogosphere to see what is being written about the company, and another 10% monitor social networking sites.</p>
<p>Of the 43% of companies that monitor e-mail, 73% use technology tools to automatically monitor e-mail and 40% assign an individual to manually read and review e-mail.</p>
<p>“Concern over litigation and the role electronic evidence plays in lawsuits and regulatory investigations has spurred more employers to monitor online activity. Data security and employee productivity concerns also motivate employers to monitor Web and e-mail use and content,” said Nancy Flynn, executive director of The ePolicy Institute and author of The ePolicy Handbook, 2nd Edition (AMACOM, 2008), E-Mail Rules (AMACOM 2003), Instant Messaging Rules (AMACOM 2004), Blog Rules (AMACOM 2006), and other books related to workplace computer use.</p>
<p>“Workers’ e-mail and other electronically stored information create written business records that are the electronic equivalent of DNA evidence,” said Flynn, noting that 24% of employers have had e-mail subpoenaed by courts and regulators and another 15% have battled workplace lawsuits triggered by employee e-mail, according to 2006 AMA/ ePolicy research. “To help control the risk of litigation, security breaches and other electronic disasters, employers should take advantage of monitoring and blocking technology to battle people problems—including the accidental and intentional misuse of computer systems and other electronic resources,” Flynn said.</p>
<p>While only two states, Delaware and Connecticut, require employers to notify employees of monitoring, the majority are doing a good job of alerting employees when they are being watched. Fully 83% inform workers that the company is monitoring content, keystrokes and time spent at the keyboard; 84% let employees know the company reviews computer activity; and 71% alert employees to e-mail monitoring. But are employers doing enough to educate employees on their specific policies?</p>
<p>“Most employees receive policies regarding use of office business tools and privacy issues on the first day of employment, but too often they don’t read them. Employers need to do more than hand over a written policy,” says Manny Avramidis, senior vice president of global human resources for AMA. “They should educate employees on company expectations and offer training on an annual basis.”</p>
<p>Telephone and Voice Mail:</p>
<p>Six percent of employers have fired employees for misuse or private use of office phones. Fully 45% monitor time spent and numbers called, and another 16% record phone conversations. An additional 9% monitor employees’ voicemail messages. Most employers notify employees of phone (84%) and voicemail (73%) monitoring.</p>
<p>Video Surveillance:</p>
<p>Almost half (48%) of the companies surveyed use video monitoring to counter theft, violence and sabotage. Only 7% use video surveillance to track employees’ on-the-job performance. Most employers notify employees of anti-theft video surveillance (78%) and performance-related video monitoring (89%).</p>
<p>Global Satellite Positioning and Emerging Surveillance Technology:</p>
<p>Employers who use Assisted Global Positioning or Global Positioning Systems satellite technology are in the minority, with only 8% using GPS to track company vehicles; 3% using GPS to monitor cell phones; and fewer than 1% using GPS to monitor employee ID/Smartcards. The majority (52%) of companies employ Smartcard technology to control physical security and access to buildings and data centers. Trailing far behind is the use of technology that enables fingerprint scans (2%), facial recognition (0.4%) and iris scans (0.4%).</p>

<p>When i visit one of my companies, I have noticed when walking past that the person in question has their MSN box open and emails open in a small window thinking no one will see&#8230;. I believe it’s affecting thier work and therefore costing me money.</p>
<p>I have no problem with personal access to these things as long as it is not affecting work and they are not taking the Mick..</p>
<p>So, is there any legal implications to store this information and use in future for disciplinary reasons?</p>
<p>Answers:<br />
1. I removed msn from my staff&#8217;s PCs. You can also get a firewall to block hotmail, yahoo, facebook etc.</p>
<p>Also, provide your staff with an internet and pc policy, get them to sign it and if they breach it, then follow the correct procedures.</p>
<p>2. we come across this problem regularly amongst our customers.</p>
<p>you are legally entitled to monitor your bandwidth and the website traffic. If you want your staff to abide by any company rules regarding internet and email then as Richie says, you must get them to sign saying they agree to the rules and are aware of them.</p>
<p>we install managed firewalls, pre-configured to give you reports on company useage, it&#8217;s amazing how many people abuse the use of the internet. one company who had 10 accounts staff found out 8 of them where playing games with each other on facebook all day, literally only 2 were doing any work.</p>
